Medical Malpractice

Medical malpractice, simply put, occurs when your medical provider deviates from the standard of care that was required under the circumstances and that failure causes injury. The standard of care required of a physician means having the same knowledge and skill and using the same care normally used in the medical profession under similar circumstances.

A physician whose conduct falls below this standard of care is negligent. Similarly, a physician who professes to be a specialist in a particular field of medicine must have the same knowledge and skill and use the same care as others in that same medical specialty. A specialist whose conduct does not meet this professional standard of care is negligent.

Though the majority of health care providers strive to do good work, mistakes are sometimes made which can adversely affect a person for the rest of his or her life, sometimes even catastrophically.
